National Interest Waiver - National Interest Waiver Requirements

What is the National Interest Waiver

The national interest waiver (NIW) is part of the second employment-based category (EB2) for aliens of exceptional ability in sciences, arts or business and  advanced degreed professionals (M.A., M.S., M.E., M.D. or Ph.D.). Ph.D.  students also qualify. An alien may apply for permanent residence status (Green Card) and seek a waiver of the offer of employment by  establishing that his or her admission to permanent residence would be  in the national interest.

The national interest waiver is a good option for those who do not wish to  wait several years for labor certification or those who do not wish to  be tied to a specific employer during labor certification. The national  interest waiver applicant sponsors him or herself and is not required to have a job. National interest waiver applicants may make additional green card applications while their national interest waiver petition is pending. Furthermore, if the National Interest Waiver applicant  is employed, the employer will not have knowledge of a pending national interest waiver  application.

Since 2002, the Messersmith Law Firm, P.C. has represented thousands  of clients nationwide from countries all over the world. While we have had many difficult and challenging cases, we have had tremendous success with self sponsored green card applications which has drawn many, many  foreign nationals to retain our firm.

Our office has handled thousands of green card related cases, primarily EB1 and National Interest Waiver self sponsored cases.  At our  firm, we will give you an honest assessment of your case merits and  chance for success.  There have been many instances where foreign nationals decided to apply without representation or through other legal services that have later  sought our help due to errors or appeal denied cases.  While, we are  happy to help these people obtain approvals, either through reopening a  denied case or through an appeal, it can be more costly and time consuming than if we had been retained from the beginning.

In all of our cases, an attorney will handle your matter.  Unlike other firms who employ multitudes of paralegals or law clerks, we further guarantee that an attorney will handle your case from start to finish.
